1. Introduction
Welcome to SkyFuns. These Terms of Service ("Terms") govern your use of the SkyFuns website, mobile application, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
2. Eligibility
You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you meet this requirement. If you are using the Services on behalf of a company or organization, you represent and warrant that you have the authority to bind that entity to these Terms.
3. Account Registration
To access certain features of our Services, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.
4. Booking and Cancellation
When you book a flight through our Services, you agree to pay the specified fees. Payment terms are specified at the time of booking. Cancellation policies vary by flight and are specified at the time of booking. Generally, cancellations made at least 48 hours before the scheduled flight are eligible for a full refund. Cancellations made less than 48 hours before the scheduled flight may be subject to cancellation fees.
5. Safety and Compliance
Safety is our top priority. All flights are subject to weather conditions and pilot discretion. We reserve the right to cancel or reschedule flights due to safety concerns, including but not limited to adverse weather conditions, mechanical issues, or pilot availability. In such cases, you will be offered a full refund or the option to reschedule.
You agree to comply with all safety instructions provided by the pilot and ground crew. Failure to comply with safety instructions may result in the cancellation of your flight without refund.
6. User Conduct
You agree not to use our Services for any unlawful purpose or in any way that could damage, disable, overburden, or impair our Services. You also agree not to attempt to gain unauthorized access to any part of our Services, other accounts, computer systems, or networks connected to our Services.
7. Intellectual Property
All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of SkyFuns or its licensors and are protected by copyright, trademark, and other intellectual property laws.
8. Limitation of Liability
To the maximum extent permitted by law, SkyFuns shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.
9. Indemnification
You agree to indemnify, defend, and hold harmless SkyFuns and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your use of the Services or violation of these Terms.
10. Modifications to Terms
We reserve the right to modify these Terms at any time. If we make changes, we will provide notice by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our Services after such notice constitutes your acceptance of the modified Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California.
